These Terms of Service (“Terms”) govern your access to and use of the VirtueStrong platform (“Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be 18 years or older to use VirtueStrong. By using the Service, you affirm that you are at least 18 years of age.

2. User Accounts

Users must authenticate via Google, Apple, or create a secure username/password login
You are responsible for maintaining the confidentiality of your login credentials
We reserve the right to suspend or terminate accounts for misuse or violation of these Terms

3. Use of the Service

You agree to use the Service only for personal, non-commercial use
You will not use the Service to harm others, promote hate, or disseminate false or abusive content
You must not attempt to reverse engineer, duplicate, or exploit any part of the Service

4. Intellectual Property

All content, including Guide personas, audio, visuals, branding, and system logic, is the property of VirtueStrong, LLC or its licensors. You may not reuse or republish this content without permission.

5. Health & Wellness Disclaimer

VirtueStrong is not a medical or clinical tool. It does not provide therapy, diagnosis, or treatment for any medical or mental health condition. By using this Service, you acknowledge:

It is not a substitute for professional advice or care
It is not intended for use in crisis situations
No claims are made regarding healing, recovery, or medical benefits

5.1 No Duty of Care and No Real-Time Monitoring

You acknowledge and agree that VirtueStrong, LLC does not provide any form of medical, clinical, or emergency care, and assumes no duty of care for your physical, emotional, or psychological well-being. Use of the Service does not create any provider-client, fiduciary, or therapeutic relationship.

The Service is not monitored in real time. No part of the platform—whether AI-generated or staff-supported—is designed or guaranteed to detect risk, prevent harm, or respond to crisis situations. If you are in distress, facing a mental health emergency, or are concerned about your safety or someone else’s, you should contact a licensed professional or emergency services immediately.

5.2 No Human Interaction or Representation

You understand and acknowledge that all interactions on the VirtueStrong platform are generated by artificial intelligence. The “Guides” presented within the Service are fictional personas powered entirely by software and are not real individuals. Any names, voices, tones, or personalities are designed to enhance engagement and personal reflection, not to imply a real person is present or interacting with you.

While the Guides may appear empathetic or conversational, they do not possess consciousness, emotions, or awareness. No part of the Service involves communication with a real human being unless explicitly stated otherwise.

5.3 Technology Balance

VirtueStrong encourages intentional use. While the Service is designed to support emotional resilience and personal growth, it should not replace offline reflection, rest, relationships, or professional care.

You are solely responsible for how much time you spend using the Service. We make no claims regarding the effects of screen time and assume no responsibility for any impact resulting from prolonged use of digital devices. We recommend engaging with the Service as a supplement—not a substitute—for lived experience.

6. Communication and Marketing

You may receive system notifications, updates, and promotional content via email and SMS (if opted in)
You can manage communication preferences in your account settings
Guides may send user-specific engagement messages to encourage use and consistency

7. Termination

We may suspend or terminate access for violation of these Terms or other misconduct
You may delete your account at any time

8. Governing Law

These Terms are governed by the laws of the State of Florida. All disputes shall be resolved exclusively in the courts located in Leon County, Florida.

9. Usage & Fair Access Policy

VirtueStrong is designed for regular, personal use. Excessive or abusive usage may impact our ability to offer high-quality service for all users. We reserve the right to impose a $25/month excessive usage fee if your use significantly exceeds typical patterns. This includes, but is not limited to:

Automated or scripted interactions
Sustained high-volume interactions
Use of the Service for bulk content generation

We will notify you before any fee is applied.

10. Subscription, Cancellation, and Data Retention

VirtueStrong is a monthly subscription service. You may cancel at any time.
Once cancelled, your access continues through the remainder of your billing cycle (one month from your last renewal).
We do not offer refunds for unused time.
If your subscription lapses or is cancelled, your account will be considered inactive.
Account data, including your full conversation history, will be permanently deleted 90 days after the account becomes inactive. Once deleted, data cannot be recovered.

11. Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT VIRTUESTRONG IS POWERED BY ARTIFICIAL INTELLIGENCE, AND THAT AI-BASED SYSTEMS MAY PRODUCE RESPONSES THAT ARE INACCURATE, INCOMPLETE, OR UNSUITED TO YOUR PERSONAL SITUATION. WHILE WE STRIVE FOR QUALITY AND RESPONSIVENESS, YOU UNDERSTAND THAT ERRORS, OMISSIONS, AND MISINTERPRETATIONS MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRTUESTRONG, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.

IN NO EVENT SHALL VIRTUESTRONG'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE INCIDENT GIVING RISE TO THE CLAIM.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK, AND THAT THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." YOU ARE SOLELY RESPONSIBLE FOR HOW YOU INTERPRET AND APPLY ANY INFORMATION PROVIDED BY THE SERVICE. VIRTUESTRONG MAKES NO GUARANTEES REGARDING THE ACCURACY, RELIABILITY, OR SUITABILITY OF RESPONSES GENERATED THROUGH AI.

YOU AGREE NOT TO RELY ON THE SERVICE FOR EMERGENCY, CLINICAL, OR PROFESSIONAL SUPPORT, AND ACKNOWLEDGE THAT THE SERVICE DOES NOT CONSTITUTE MEDICAL, MENTAL HEALTH, OR SAFETY INTERVENTION. YOU WAIVE ANY AND ALL CLAIMS, NOW OR IN THE FUTURE, ARISING FROM YOUR USE OF THE SERVICE EXCEPT AS EXPRESSLY PROVIDED UNDER THESE TERMS.
